ChalkUp Credit Solutions provides credit education and advocacy services to consumers, with a focus on active-duty service members, veterans, and military families.
ChalkUp Credit Solutions is not a law firm and does not provide legal advice. The information and services provided do not constitute legal counsel, representation, or advice. For legal matters, consult with a licensed attorney, JAG legal assistance office, or consumer law specialist.
Outcomes of credit advocacy services depend on individual circumstances, the accuracy of information provided, the responsiveness of credit bureaus and furnishers, and other factors beyond ChalkUp's control. Results vary by case.
By engaging ChalkUp Credit Solutions, you acknowledge that you understand the nature of the services provided and that no specific outcomes have been promised or guaranteed.
Under the Credit Repair Organizations Act (15 U.S.C. § 1679 et seq.), you have the following rights:
Right to a Written Contract: You have the right to receive a written contract detailing the services to be performed, payment terms, and cancellation rights.
Right to Cancel: You have the right to cancel any contract with ChalkUp Credit Solutions within three (3) business days of signing, without penalty or obligation.
No Advance Fees: ChalkUp Credit Solutions may not charge or receive payment for services until those services have been fully performed.
Right to Self-Dispute: You have the right to dispute inaccurate information on your credit report yourself, at no cost, by contacting credit bureaus directly.
For more information about your rights under CROA, visit the Federal Trade Commission website at ftc.gov or contact the Consumer Financial Protection Bureau at consumerfinance.gov.
The Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.) provides consumers with specific rights regarding their credit reports:
Right to Dispute: You have the right to dispute inaccurate, incomplete, or unverifiable information on your credit report with credit bureaus and furnishers.
Right to Free Credit Reports: You are entitled to one free credit report from each of the three major credit bureaus (Equifax, Experian, TransUnion) every 12 months through AnnualCreditReport.com.
Investigation Timeframes: Credit bureaus generally have 30 days to investigate disputes (45 days if additional information is provided during the 30-day period).
Right to Documentation: You have the right to request documentation supporting disputed items from furnishers and bureaus.
Role Distinction: Credit bureaus compile and report information. Furnishers (creditors, lenders, collectors) provide the information. Both have obligations under FCRA.
ChalkUp Credit Solutions assists clients in exercising these FCRA rights through documentation, dispute strategy, and communication with bureaus and furnishers. However, ChalkUp cannot force bureaus or furnishers to take specific actions.
The Servicemembers Civil Relief Act (50 U.S.C. § 3901 et seq.) and the Military Lending Act (10 U.S.C. § 987) provide specific protections to eligible service members, including interest rate caps, foreclosure protections, and lending restrictions.
ChalkUp's Role: ChalkUp Credit Solutions helps clients understand these laws, identify potential violations, and document circumstances that may support claims under SCRA or MLA. ChalkUp assists in preparing communications to creditors and bureaus regarding these protections.
Important Limitations: ChalkUp does not guarantee that creditors will honor SCRA/MLA claims, nor does ChalkUp guarantee enforcement outcomes. Application of these laws is determined by creditors, courts, and regulatory agencies. For legal enforcement of SCRA/MLA rights, consult JAG legal assistance, Military OneSource, or a consumer attorney.
Eligibility for SCRA and MLA protections depends on military status, timing of debt incurrence, and other statutory requirements. Not all service members qualify for all protections under all circumstances.
ChalkUp Credit Solutions makes no guarantees regarding outcomes of credit advocacy services.
No Guaranteed Score Increases: ChalkUp does not guarantee any specific credit score increase or timeline for improvement.
No Guaranteed Removals: ChalkUp does not guarantee removal of any specific item from credit reports, even if the item appears inaccurate.
No Guaranteed Timelines: ChalkUp does not guarantee that disputes or advocacy efforts will be resolved within any specific timeframe.
No Loan or Clearance Guarantees: ChalkUp does not guarantee approval for loans, mortgages, security clearances, or any other credit-dependent outcomes.
Results depend on factors including but not limited to: accuracy of client-provided information, responsiveness of credit bureaus and furnishers, legal merit of disputes, documentation quality, creditor policies, and regulatory agency actions.
Past results for other clients do not predict or guarantee future results for any individual client.
Effective credit advocacy requires client participation and accuracy. Clients are responsible for:
Providing Accurate Information: All information provided to ChalkUp must be truthful, accurate, and complete. Providing false or misleading information may result in termination of services and potential legal consequences.
Supplying Documentation: Clients must provide requested documentation (credit reports, deployment orders, payment records, correspondence) in a timely manner.
Financial Obligations: Clients remain legally responsible for all legitimate debts and financial obligations. Credit advocacy does not eliminate valid debt.
Responsiveness: Clients must respond to ChalkUp communications and bureau/creditor correspondence in a timely manner. Delays may affect outcomes.
Reviewing Documents: Clients are responsible for reviewing and understanding all documents, contracts, and disclosures before signing.
Failure to meet these responsibilities may result in reduced effectiveness of services or termination of the client relationship.
ChalkUp Credit Solutions communicates with clients through phone, text message (SMS), and email regarding services, account updates, and educational information.
Consent Requirement: By engaging ChalkUp's services or providing contact information, you consent to receive communications from ChalkUp via the methods listed above. This consent is documented and maintained as part of your client record.
